Terms and Conditions of the participation in the EUREM Energy Management Training at DEinternational Taiwan Ltd.

 

1. Organizer

The EUREM Energy Management Training (“the Event”) is supervised by the German Trade Office Taipei (“GTO”), represented by Executive Director and Chief Delegate Mr. Axel Limberg, and organized by GTOs service unit DEinternational Taiwan Ltd. (“DE”), represented by General Manager Ms. Leonie Yang.

2. Conclusion of the Contract

The Contract is concluded between DE and the Participant when DE confirms the acceptance of registration sent from the Participant.

3. Registration of the Event

3.1 Request of Registration: The registration of the Event shall be applied by the Participant on the designated webpage of the Event. The Participant confirms that sufficient time was given to review all the terms and conditions of the Event and relevant privacy policy, and all are read thoroughly and accepted by submitting the request of registration to DE. The request of registration is an offer to DE with binding effect. Request of registration will be considered in the order in which it is received and only until the registration deadline.
3.2 Notice for Request of Registration: The Participant shall receive a notice from DE to confirm that request of registration is duly received. This notice shall not constitute an acceptance in terms of the request of Registration.
3.3 Confirmation of Registration: DE shall send a confirmation through email to the Participant to accept the request of registration. The contract of the Event is concluded between DE and the Participant. DE shall have the discretion to validate any request of registration, if there is any concern in this regard, DE will contact the Participant for clarification in due course.

4. Participation Fee

4.1 The participation fee of the Event applies to different schemes as follows:

  • Standard Fee: 65,000 NTD per person.
  • Early Bird Fee: 60,000 NTD (now till 2022/12/31) per person.
  • Business Alliance Member Fee: 58,500 NTD per person.
  • Multiple Participants Fee: registrations of 2 or more participants in the same organization shall apply the fee of 58,500 NTD per person.

4.2 All prices are including VAT, multiple discounts are not applicable.

5. Payment Method

5.1 Down Payment: Upon receiving the Confirmation of Registration from DE, the Participant shall receive an invoice of the 10% of the Participation Fee as a down payment. The down payment shall be made within 30 calendar days after the invoice is received.
5.2 Second Payment: The remaining amount of the Participation Fee shall be paid within 30 calendar days upon receiving the second invoice sent from DE. All payments have to be made before the start of the Training.
5.3 All the payments shall be made by bank transfer to DE’s designated bank account, the Participant shall bear the expense of each bank transaction if any, and provide reference number of remittance and name of payer in writing to DE per confirmation.
5.4 Any default on the payment shall cause the cancellation of the Event, which the Cancellation policy of Article 6 prescribed herein shall apply, unless otherwise there is an exception agreed by DE.

6. Cancellation Policy

Request for cancellation on Registration of the Event from the Participant is feasible, the cancellation policy as follows shall apply:

6.1 All the request to DE for cancellation on Registration of the Event shall be done in writing, the format of this request can be referred to Attachment 1: Cancellation Form.
6.2 Refund of the Participation Fee:

  • Cancellation occurs after down payment is made up to 30 days before the start of the Event: 10% of the Participation Fee will be charged as a flat-rate cost, the remaining Participation Fee will be refundable if applicable.
  • Cancellation occurs within the period of 29 days to 48 hours before the start of the Event: 30% of the Participation Fee will be charged as a flat-rate cost, the remaining Participation Fee will be refundable if applicable.
  • Cancellation occurs within the period of 48 hours before the start of the Event: 100% of the Participation Fee will be charged as a flat-rate cost, no Participation Fee will be refundable.

6.3 Administrative Procedure for refund: Any refund will take up to 20 calendar days to process, the Participant shall bear the expense of each bank transaction if any.

6.4 Substitute Participant:

  • The participant is entitled to have substitute participant for his/her Registration of the Event only for once per registration.
  • The information of the Substitute Participant shall be provided to DE per validation, once it is confirmed by DE all the terms and conditions of the Event shall be applied to the Substitute Participant.
  • DE will not reissue the invoice to the Substitute Participant, unless otherwise it is agreed by DE in writing.
  • A Substitute Participant can only be registered as long as that Event has not started.

6.5 If there are special provisions in terms of cancellation policy prescribed for special course, such as Practical Course of Study, the special provisions shall prevail and be apply to.

7. Termination of the Event

7.1 The term of the Event begins on the first day of the Event and ends on the last day of the Event.
7.2 The Participant is entitled to terminate the Event within the term of the Event, the Participation Fee is not refundable.
7.3 No certificate will be issued to Participant if the Participant terminates the Event earlier.
7.4 Article 6.5 shall apply.

8. Place of performance

The place of performance for the service of DE is online via MS Teams, unless otherwise stated.

9. House rule

The house rules in force at the venue, if any, must be observed by the Participant.

10. Intellectual Property Rights

10.1 The computer software used, and the working documents of the Event are protected by copyright, trade secret, know-how, any other Intellectual Property Rights. Copying and/or passing on to third parties is only permitted with the prior consent of the right holder.
10.2 Audiovisual recordings of events are not permitted to the Participant. In case of recording by DE, a separate information with declaration of consent will be given to the Participant.
10.3 The Participant irrevocably consents, free of charge, that DE is entitled to create, reproduce, broadcast or have broadcast image and/or sound recordings of themselves and to use them in audiovisual media per promotion of the Event or any activity held by DE, regardless of applicable data protection regulations, unless the Participant formally objects to in writing at any time.  

11. Data Protection

Personal data will be processed by DE as the controller within the meaning of data protection law.

11.1 For the purpose of fulfilling this contract, personal data of individuals of the Participant (“the Individuals”) may be collected, stored and processed by DE, or any third party designated by DE. This applies with reasonable time period case by case to personal data which serve for the purpose of identification of the Individuals (e.g., name, profession, address, date of birth and other required personal information). DE may share the Individuals ´s data with third parties and request third parties to comply with applicable laws, if it is necessary to fulfill obligations of this Agreement. All data processing procedures (e.g., collection, processing and use) are carried out by DE, or any third party designated by DE in accordance with applicable laws and is done exclusively for the purpose of fulfilling this Agreement. The data will be stored only to the extent that is necessary to fulfillment of the order.
11.2 The Individuals have the right to make any request about this data collection, processing and use, to the competent data protection supervisory authority and may demand, subject to fulfillment of the legal conditions, information, rectification, erasure or restricted processing, object to the processing or assert his right to data transferability.

12. Liability of DEinternational Taiwan Ltd.

Except for intentional damage, and/or for direct violation of this contract with regard to the provision of the Event, in no event shall DE be liable toward the Participant for any damages of any kind, including any direct, indirect, special or consequential damages or any loss of revenue, profits, or data arising in connection with this contract.

13. Disclaimer of DEinternational Taiwan Ltd.

13.1 The Event may be cancelled or terminated by DE for good cause, in particular due to a lack of participants to cover costs, due to the unavailability of the speaker at short notice without the possibility of employing a substitute speaker, or due to force majeure, including but limited to in the event of a pandemic or the impossibility of holding the event due to restrictions under government/official orders (regardless of their legality), or due to any public authority’s decision. The participant will be informed immediately by DE about the cancellation or termination of the Event and the refund policies are prescribed hereafter, further claims are excluded subject to the provision of Article 12.

  • Cancellation before the Event starts: the paid amount of the Participation Fee will be refunded, 10% of paid amount will be charged as a flat-rate cost for the administrative use.
  • Termination after the Event starts: the Participant Fee will be fully refunded, 10% of paid amount will be charged as a flat-rate cost for the administrative use when this termination causes (a) the examination of the Event to obtain the certificate or (b) delivery of the Event, no longer possible.
  • Administrative Procedure for refund: Article 6.4 shall apply.

13.2 DE is entitled to change speakers/lecturers/trainers, to change the location or the schedule, and to change from a face-to-face event to an online event, or to reschedule for the postponed courses for good cause, e.g., due to illness of the speaker or in the event of a pandemic, provided this is reasonable. Insofar as the overall design of the Event is not significantly impaired, the change of lecturer/trainer, shifts in location or in the schedule, as well as the change from a face-to-face event to an online event do not entitle the Participant to cancel the Registration of the Event or terminate the Event with reimbursement or ask for the deduction on the Participation Fee.

13.3 DE reserves the right to change these terms and conditions from time to time with prior notice.

14. Governing Law, Place of Jurisdiction

This contact shall be governed and construed by the laws of Republic of China (Taiwan). Both parties agree on the Taipei District court as the governing court in case of dispute.

15. Severability clause

If an individual term of this agreement, shall be, or become, void in whole or in part, the validity of the remaining terms shall not thereby be affected. The ineffective provision will be replaced by the statutory ruling or shall be replaced by an effective provision which comes closest to the intended purpose.
